ProperGate Software uses the collected data for various purposes:

User account/registration

In order to use our platform to monitor your material delivery via our website, you as a user must confirm registration provided by project logistics coordinator on the website with a password of your choice and the following personal data entered by the coordinator: First and last name, company name, e-mail address and phone number. We need this information to identify you and to communicate with you and send you real-time notifications. It is obligatory to provide the above-mentioned data. We will then set up a password-protected direct access to your data stored with us in your user account. Here you can see and manage all information about your deliveries and materials and all data in the protected user area.

In addition, certain users have the possibility to store data of third parties on the platform. This happens when personal data of a „supplier” and „supplier’s driver” (name, e-mail address, telephone number) is stored while the supplier and the driver themselves are not users of the platform. The data enables communication between the parties involved. The data will not be passed on to third parties.

Log Data

Whenever you visit our Service, we only collect the personal data that your browser sends to our server (server Log Data files/access data) on the basis of Art. 6 Para. 1 S. 1 lit. b) and f) GDPR in order to display our website and to guarantee stability and security.

This Log Data may include information such as your

• name and content of pages of our Service that you visit
• computer’s Internet Protocol (“IP”) address,
• browser version,
• your operating system & language,
• the time and date of your visit,
• time zone difference to Greenwich Mean Time (GMT)
• the time spent on those pages,
• the amount of data transferred,
• access status/HTTP status code (referrer URL)
• and other statistics.

Log file information is stored for a maximum of 7 days for security reasons (e.g. to investigate misuse or fraud) and then deleted. If further storage is required for evidentiary purposes, this data is excluded from deletion until the respective incident has been finally clarified.

Cookies

We use cookies on our websites. These are files with small amount of data that is commonly used an anonymous unique identifier. These are sent to your browser from the website that you visit and are stored on your computer’s hard drive.

Our website uses these “cookies” to collection information and to improve our Service. You have the option to either accept or refuse these cookies, and know when a cookie is being sent to your computer. If you choose to refuse our cookies, you may not be able to use some portions of our Service. It also recognises what entries and settings you have made so that you do not have to enter them again.

On the other hand, we use cookies to statistically record the use of our website by services of our service providers and to evaluate them for you for the purpose of optimising our offer. These cookies are deleted after a defined period of time.

Third parties may also use so-called pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. Pixel tags can be used to evaluate information such as visitor traffic on the web pages. With their help, an individual cookie, i.e. a small file, is stored on the user’s device (comparable technologies can also be used instead of cookies).

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you are located outside Poland and choose to provide information to us, please note that we transfer the data, including Personal Data, to Poland and process it there.

ProperGate Software will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

ProperGate Software may disclose your Personal Data in the good faith belief that such action is necessary to:

• To protect against legal liability

Rights of the parties concerned

In accordance with Article 15 of the DS GMO, you have the right to obtain, upon request and free of charge, information on the personal data that has been stored about you.

In accordance with Articles 16, 17 and 18 GDPR, you also have the right to have incorrect data corrected and your personal data blocked, deleted or processed to a limited extent.

Subject to the conditions laid down in Article 20 of GDPR, you are also entitled to receive the personal data concerning you that have been stored in a structured, current and machine-readable format and to transmit this data to another person in charge without ProperGate’s interference.

In addition, pursuant to Art. 21 para. 1 GDPR, you are entitled to the reject the permission of processing of personal data concerning you, which is based on Art. 6 para. 1 lit. e) or f) GDPR, for reasons arising from your personal situation.

Objections to direct advertising can always be expressed. ProperGate will fulfil your aforementioned rights, as far as the legal requirements for the assertion of the rights are given.

Any requests regarding your personal data should be addressed to the e-mail address or address given in the imprint of our web pages or under point 1 of this data protection declaration.

You also have the right to file a complaint with a data protection supervisory authority about our processing of your personal data.

Security Of Data

Security of data transmission

The security of your data is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Duration of storage and routine deletion

We process and store personal data only for the period required to achieve the processing purpose or for as long and to the extent required by law, but at least for the duration of the statutory limitation periods.

If the storage purpose no longer applies or if a legally prescribed storage period expires, the personal data will be blocked or deleted routinely and in accordance with legal regulations.

Google Analytics is a web analysis service of Google Inc. based in the USA (hereinafter ”Google”). Google Analytics uses cookies, which enable an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there.

Google has committed to the principles of the privacy shield by self-certification with the US Department of Commerce.

We use Google Analytics only with active IP anonymization. For this reason, Google will reduce your IP address in member states of the European Union or in other signatory states to the Agreement on the European Economic Area beforehand. Sentry is an error monitoring service. The system captures information about platform crashes and malfunctions on your end device to improve the platform. Your IP address is only collected in an anonymous form and together with technical data of the terminal device (such as operating system version, screen resolution, device ID) is transmitted to the Sentry servers. It is not possible to draw any conclusions about a specific person. The legal basis for the use of Sentry is Art. 6 para. 1 sentence 1 lit. f) GDPR.

Sentry is self-certified by the U.S. Department of Commerce to comply with the principles of the Privacy Shield.

Cloud

Microsoft Azure Cloud Service – integration of third-party services for the purpose of web hosting
We use server capacities of providers through which we can offer you our services online via our websites (web hosting). The legal basis for this is Art. 6 para. 1 sentence 1 lit. b) GDPR.

For this purpose:

• inventory data,
• contact data,
• content data,
• contract data,
• usage data,
• user meta- and communication data

are transmitted to the service providers.

We carefully select our host providers. We only cooperate with providers based in the EU or, if the provider is based outside the EU or EEA, that the provider can demonstrate an adequate level of data protection (e.g. Privacy Shield).

Sales & Marketing

Google Marketing Services – the marketing and remarketing services (“Google Marketing Services”) of Google LLC based in the USA for analysing, optimising and operating our online offering economically. The legal basis is Art. 6 para. 1 sentence 1 lit. f) GDPR.

The Google marketing services allow us to target ads for and on our site in order to present users only with ads that potentially match their interests. For example, if a user sees ads for products he has been interested in on other websites, this is referred to as “remarketing”. For these purposes, when our and other websites on which Google marketing services are active are accessed, Google directly executes a code from Google and (re)marketing tags (“web beacons”) are integrated into the website. With their help, an individual cookie is set on the user’s device (instead of cookies, comparable technologies can also be used, see also section A, paragraph 2.4). Cookies can be set by various domains, including  google.com ,  doubleclick.net ,  invitemedia.com ,   admeld.com ,   googlesyndication.com  or googleadservices.com. The cookie records which websites the user visits, what content he is interested in and what offers he has clicked on, technical information about the browser and operating system, referring websites, visiting time and other information about the use of the online offer. The IP address is also transmitted, but only in anonymized form (for more information, see Section B, Section 3.1., Para.

The IP address is not combined with the user’s data within other Google offers. The above information may be linked by Google to such information from other sources. If the user then visits other websites, the ads tailored to his interests can be displayed.

Users data is processed pseudonymously within the framework of Google marketing services. This means that Google does not store and process, for example, the names or e-mail addresses of users, but processes the relevant data cookie-related within pseudonymous user profiles. This means from Google’s point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie holder, regardless of who this cookie holder is. This does not apply if a user has permitted Google to process the data without this pseudonymisation. The information collected by Google marketing services about users is transmitted to Google and stored on Google’s servers in the USA.

One of the Google marketing services we use is the online advertising program “Google AdWords”. In the case of Google AdWords, each AdWords customer receives a different”conversion cookie”. Cookies cannot therefore be traced through the websites of AdWords customers. The information collected by the cookie is used to generate conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers see the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, you will not receive any information that personally identifies users.

We also use the Google marketing service “AdSense” to integrate third-party advertisements. AdSense uses cookies that enable Google and its partner sites to serve ads based on users’ visits to this site or other sites on the Internet.

We can also use the “Google Tag Manager” to integrate and manage Google analysis and marketing services into our website.
